What you need to know about Berger International’s legal case fiasco

Its subsidiary was sued by one unhappy customer last year, and the claim was dismissed by the High Court - but now the Court of Appeal just overturned this decision.

In February 2010, a customer sued BPS and claims that paint sold by BPS to the customer was defective and/or unfit for purpose. In December 2010, BPS announced that the Court has dismissed the Claim and allowed the counterclaim by BPS against the customer of S$72,677 for outstanding amounts owed by the customer.

Now, in a release, the company announced that that the Court of Appeal of the Republic of Singapore has overturned the decision of the High Court in respect of the Claim, with the amount of damages due from Berger Paints Singapore or BPS to the customer to be assessed at a later date. BPS is considering its options in view of the decision of the Court of Appeal and the Company will make an appropriate announcement in due course.
